Here is what we requested from NTM in June of 2009

1. A phone call to every one involved in NTM Senegal (missionaries, parents, MKs, abusers) offering reimbursement of counseling expenses. Provide quality and intensive counseling for a lifetime or however long it is desired at a licensed therapist of the MKs choice.

2. Every person in leadership at that time to be investigated (out of house) as to their involvement and if it was determined they showed any knowledge and lack of response to be immediately dismissed from NTM.

3. A letter of apology written to the Senegalese national church.

4. Public pages taken out in newspapers expressing your deep sorrow and desire to stand behind us now and become our greatest advocate.

5. Each abuser named who is still with NTM to be thoroughly investigated in the presence of NTM, any interested MKs and parents, and an outside mediator/lawyer. Dismissed immediately if found to be guilty, and prosecuted to the full extent of the law.

6. Get a qualified therapist on staff, immediately.

These are things we would like to see happen. I believe a contrite heart would reveal more steps you can make toward restitution and the repairing of the relationship between you, the mission, and us, those who possibly know you best as we grew up under your leadership. Ours hearts really long for a restoration of that relationship. You were our family, and our church.

So this means that we wait yet again? Until August 31?? To find out if the lawsuit will be dismissed or not?

I wish we knew what the grounds are for the requested dismissal. (And of course I also wonder if the judge will be convinced.)

Sheesh ... NOBODY is in any big hurry about any of this.

Or does this mean the motion to dismiss was denied, and on August 31st, there will be a hearing about the lawsuit itself??

It is a hearing on the Motion to Dismiss. You also may be able to order a copy of the Motion to Dismiss from the clerk. Or, if anyone lives close to the clerk's office, walk in and make a copy.

I think that's correct. The motion to dismiss would be a written motion. The hearing will be to discuss the merits of the motion. Once we get a hold of a copy, I'm sure it will be a motion to dismiss based on legal items such as jurisdiction and statutes of limitations. We'll see.

Gene Long: To those who have not taken legal action, NTM generally says something like, "We are not going to resolve this by continuing this conversation and this will be the last time we respond."

We would laugh if it weren't so NOT funny. That's almost exactly what we were told.

Motion to dismiss is not a unique strategy to NTM or even necessarily motivated by intent to delay. Virtually every suit I've ever heard of is immediately followed by such a response from the defendant (regardless of the merits). Why not try to end the whole thing ASAP if you can? It's true that some delay can also add time to build defense case or begin settlement negotiations but hardly as much of a motivation as ending the whole issue before it has made it very far.

By the way, I think the the topic of this thread is crucial to the long-term benefits of this whole forum. The community and (re-)connection is probably most important for the healing process of many. However, I am encouraged to see that written goals/requests for NTM action were communicated to NTM early in the process.
