To state the obvious. . . New Tribes Mission knows which schools have had reports of abuse. They know when the abuse occurred, and they know when it came to light. They know the names of the perpetrators. They also know whether or not it was reported to the authorities in the land where the crime was committed, or in the passport country of the criminals.

Have they been "well advised" to continue hiding this information?

Why are victims and their families left to try to piece this information together on their own?

NTM is afraid they will have too much to loose. Like going to jail for being part of contributing to these crimes by not reporting them in a timely manner like the law states they are required to. heck if they had a part it, it can be say 10-30 years in prison. look it up http://www.justice.gov/usao/eousa/foia_reading_room/usam/title9/75mcrm.htm#9-75.110

Do the crime, do the time. We (That Girl) and I have exhausted our diplomacy. More to come...

So, let's see if I got this right. . .

NTM has evidence in their files of atrocious crimes committed against children in the Republic of the Philippines by Les Emory. They have evidence of his confession of those crimes. They have names and contact information for those who can corroborate this evidence.

When asked by a victim to provide this information to the authorities in the Republic of the Philippines - a country in which New Tribes Mission employees work, where the crimes were committed by NTM employees and whose laws were violated, to say nothing of the insult to their sovereignty as a nation in allowing the criminal to escape without being reported - they tell the victim, "Have your lawyer call our lawyer."

So, victims of criminal activity require an attorney before NTM will turn over evidence to the police? This is professional ethics?

Oh. Almost forgot. Merry Christmas, NTM. Put Christ back in Christmas and honk if you love Jesus.

Jerry,

Thank you for your e-mail outlining your most recent thoughts. We would like to provide an update on our efforts and our interaction with authorities regarding Les Emory to (That Girl), but to do so, we need to obtain your answers to some questions.

Given the serious nature of the acts that you have described, Like that is the first time you at NTM have ever heard of Les Emory's Crimes. I was born at night, but not last night... and the sensitive details pertaining to (That Girl’s) account of her victimization, we think it would be helpful and appropriate for us to speak with (That Girl) directly. That way, we can hear her personally articulate her preferences and concerns, and cooperate and collaborate with her as much as possible in pursuing justice in the Philippines and in the US. Why is it That Girls responsibility to do what you should have done 17 years ago? She was a child! Now you are going to try and follow her lead, and co-ordinate with her, all the while protecting the perpetrator and insulating him from prosecution. What is wrong with this picture? Shaking my head in disgust. If (That Girl) directly informs us that she wants you to be a part of that conversation or to speak to us on her behalf, then we will be glad to include you in that conversation. We would like to contact (That Girl) by phone this week. Could you kindly provide us a phone number where she may be reached this week and some good times for us to try to call her? There is nothing you at NTM need to say to her on the phone or in person that cannot be written. . . unless you don't want to be held accountable for what you say. It's a trust thing. You have not ours. Put it in writing.

In your email, you also suggested that we contact Attorney Filbert Flores. We would be happy to contact an attorney representing (That Girl) so we can work together to seek justice, but it was unclear to us from your email what Mr. Flores’ role is in this matter. Mr Flores is a state prosecutor working under the Vice President of the Republic of the Philippines. We contacted the Vice President, and he had Mr. Flores contact us in return. In his own words: "The law of the Philippines punishes the crimes of rape and child abuse. However, in order for the wheels of justice to move, we would need actual complainants (That was your responsibility back in 1993 and that responsibility did not... I REPEAT DID NOT expire at the end of the 1993 calender year!) who will filed criminal complaints against the alleged perpetrators. They should identify him and tell their stories of abuse. Since the Philippines and the United States has an existing extradition treaty, we need evidence to support the filing of criminal case in court as well as the request to extradite the alleged molester." We clicked on the link that you provided and it appears that Mr. Flores is a lawyer serving with the vice-president’s office in the Philippines. Is Mr. Flores a Philippines government attorney investigating this case? Has Mr. Flores been retained as a private practitioner representing (That Girl)? If Mr. Flores is representing (That Girl), then in accordance with professional rules of ethics, it would be most appropriate for our attorneys here in the USA to communicate directly with Mr. Flores (or if another That Girl has engaged other legal counsel, for our attorneys to communicate directly with them). That Girl's Attorney will contact you soon enough. You can count on it.

In addition, with respect to your request for information involving other victims of Les Emory, we understand your desire to obtain more information. However, in general we are legally obligated What you are legally and morally obligated to do is report child abuse to the police immediately where the crimes were committed, and turn over all of your investigation results to law enforcement. Everyone who was in a position of authority at the boarding school is a mandated reporter of child abuse to the police in the jurisdiction where the crimes were committed. To consider that personal or private information is gross negligence on your part. When law enforcement contacts the victims about the abuse, the victim will, at that time, have the choice to press formal charges or not. That choice, NTM, is NOT yours to make. To suggest filtering what information gets reported to the police when crimes of this nature have taken place is in itself criminal. to preserve private or confidential information about another individual unless that person has authorized disclosure of that information or we have been required by a court or other government authority How about the Law? YOU ARE REQUIRED TO REPORT ALL YOU KNOW BY LAW to disclose the information. (There may be a few other instances when such disclosure is permissible but we have not determined that such circumstances apply here.) As we noted above in our questions regarding Mr. Flores, has (That Girl) engaged legal counsel with whom we could discuss these privacy issues?

In short, we would like to speak with (That girl) or have our attorneys speak with (That Girl's) counsel to determine how we can properly collaborate on pursuing an appropriate investigation regarding Mr. Emory, Mister Emory??? You are addressing him with the same respect as Mister Flores? And you called me by my first name. I must be chopped liver. both in the Philippines as well as in the United States. Please let us know if we can proceed on either or both fronts as next steps. More stalling tactics. For 17 years you have not reported these crimes. To suggest that you need a permission slip to report felony child molestation to the police is absurd.

We hope to receive your responses soon.

Tibby Westcott

That Girl's Reply:

Ms. Westcott,

Neither New Tribes Mission, Inc. nor its representatives have permission to call me or contact me in person. All correspondence with me must be via email or registered mail.

Please copy everything you send to me to Mr. Jerry Boyden. Mr. Boyden is my fiance. I trust him implicitly and value his judgment.

Email messages from Bing Hare and Oli Jacobsen of New Tribes Mission, Inc. have convinced us that New Tribes Mission is in possession of information that is germane to the criminal prosecution of Les Emory in the Republic of the Philippines.

These crimes were committed in the Republic of the Philippines, where Atty. Filbert C. F. Flores III is a prosecutor attached to the office of the Vice President. Employees of New Tribes Mission, Inc. knew about the crimes when they occurred and made a decision NOT to report them to the authorities in the Republic of the Philippines. It has been 17 years since these crimes were committed, and 17 years since NTM did an investigation that found at least 23 victims of sexual abuse by Les Emory. For 17 years New Tribes Mission, Inc. has not reported these crimes to the proper authorities, nor has New Tribes Mission, Inc. ever filed a criminal complaint against Les Emory in the jurisdiction where these crimes were committed..

Please send ATTY. FILBERT C. F. FLORES III, via registered mail, notarized copies of the following evidence:

1. "On March 14, 1993, Les was confronted and initially denied the allegations. The following day he admitted to molesting one girl... " and "Les was confronted …. and initially denied the allegations."

Send the names and contact information of those who confronted him.

To whom was the admission made? Include full names and contact information for each person. Send copies of all evidence supporting this statement.

What is the name of the victim? Send copies of all evidence supporting this statement.

2. "Les was told he must immediately leave the Philippines..."

Send the names and contact information of those who told him he must immediately leave the Philippines. Send all evidence supporting this claim.

3. "Outside professional help was sought by the Philippines field leadership from a counselor at Faith Academy." and "At the time the abuse was made known to us, we immediately sought professional advice … from a lawyer."

Send the name and contact information of this counselor. Send copies of all evidence supporting this statement. Send the names and contact information of the Philippine field leadership who sought this help.

Please send the name and contact information for this lawyer. Send all copies of all correspondence with this lawyer. Send all evidence supporting this claim.

4. "After a continued investigation it was found that other girls had been molested. Les was confronted with each name and confessed to his pastor to a number of others."

Send the results of that investigation including but not limited to: names and contact information of those who conducted the further investigation. Send all evidence relating to this investigation. Send the names and contact information of all victims who the investigation revealed to have been molested by Les Emory. Send evidence substantiating whether or not he confessed to having molested those other victims. Send the name and contact information of the pastor to whom he confessed a number of other cases.

5. "In May of 1993 letters were sent to each girl acknowledging the incidents."

Send a copy of this letter. Send copies of all evidence supporting this statement.

6. "Les was reported to the authorities in the USA, in Florida & Virginia (6/93) but not to the Filipino authorities."

Send copies of the written reports to authorities in the USA, in Florida & Virginia. Send all evidence relating to the decision not to report these crimes to the Filipino authorities.

7. "Les was dismissed from the mission."

Send copies of all communication with Les Emory and / or Les and Wendy Emory regarding this dismissal.

8. "Letters were sent to each of Emory’s churches clearly stating the issue and a second letter to the Philippines (6/93) stating that Les had lied and in fact more girls had been molested."

Send copies of these letters. Send copies of all evidence supporting this statement.

9. "The parent's [sic] of the first girl reporting the incident refused NTM’s offer to get counseling help for their daughter."

Send written proof of this. Send copies of all evidence supporting this statement.

10. "Two other girls have subsequently sought counseling and we have paid for that for them."

Send written proof of this, including proof of payment.

11. "…. [A] letter was sent to every family on the field from HQ explaining what was found and what the outcomes were."

Send copies of this letter.

12. "In 2002 an additional victim talked with Scott Ross."

Send the name and contact information for this victim. Send copies of all evidence supporting this statement.

13. Send written records detailing his interview with the candidate secretary. Send the candidate secretary's name and current contact information. Send copies of all evidence supporting this statement.

14. "The CPC requested a preliminary report from him but he never replied."

Send a copy of the CPC's request, and a copy of the preliminary report he was asked to file.

If NTM does not want to deal directly with ATTY. FILBERT C. F. FLORES III, this information can be sent to me and I will forward it to him.

Signed: That Girl, Victim of sexual abuse by Les Emory
